Changes on labels for rodenticides as of 1 March 2018
On 1 March 2018, the derogation period ends for the sale of rodenticides for which the labelling does not comply with 9th ATP (Adaptation to Technical Progress) of the CLP Regulation. This adaptation of the CLP Regulation to technical and scientific progress has consequences for the classification and labelling of rodenticides. After 1 March 2018, the derogation period for using the remaining rodenticides with labels that do not yet comply with the 9th ATP will then last another six months.
For biocidal products, the label cannot be changed unless the authorisation is also amended. All changes on such a label must be specified in a decision of the Ctgb. This also applies to label changes as a result of the 9th ATP of the CLP Regulation.
Applications for renewals of authorisations under the Biocidal Products Regulation have been submitted for a large number of rodenticides. For rodenticides based on anticoagulants, the changes in classification and labelling that are required to comply with the 9thATP of the CLP Regulation are included in the renewal application. However, the processing of these applications is taking longer than expected. In these procedures, the Ctgb is often dependent on how quickly other Member States can complete the assessment of these renewal applications.
Regarding holders of rodenticide authorisations based on anticoagulants for which no decision on their renewal application has been made, the Ctgb has made an agreement with the inspectorate so these applicants will not have problems after 1 March 2018. According to the new agreement, the inspectorate will use the current Ctgb decisions for its enforcement activities. This means that if the Ctgb has not yet issued a decision on the renewal of these products, the previous Ctgb decision will be used.
