When is a product on the market illegally or when is the use of a product illegal?

Three situations can be distinguished in which a product is on the market illegally or the use of a product is illegal:

  1. A product without authorisation;
  2. A product that is not used in accordance with the standard product characteristics (SPC) / instructions for use (WG); for example where a professional or non-professional use is involved;
  3. A biocidal product that is used for a product type group (PT group) for which no authorisation has been issued.
